Introduction and Scope of Services

The Terms and Conditions – hereinafter referred to as Terms and Conditions given here-under and on our website, form the basis of our agreement and understanding with you. Vacays Leisure Travel is a service facilitator and & Guests require to follow policies, rules & regulations, laws & orders of visiting destination and Countries. You are requested to read, understand and sign in acceptance all the Terms and Conditions before you register for / or buy our services for yourself / family / friends.

1) Short Title, Extent and Commencement:

These Terms & Conditions shall be called Vacays Terms & Conditions.
Terms & Conditions shall come in force from 1st December, 2023 & It will remain in force till further modification or amendment.
Definitions: In these Terms and Conditions unless the context otherwise requires
1. 1. ‘Company’ means Vacays Leisure Travel Private Limited (also called as Vacays Leisure Travel in the document)
  2. ‘Itinerary’/’Tour’ means a detailed plan for a journey with a list of places to visit; plan of travel, a book describing a route or routes of travel with information helpful to travellers and always subject to Force Majeure Situation.
  3. ‘Force Majeure’ means an event or circumstance not within the reasonable control, directly or indirectly, of Vacays Leisure Travel in its inability to perform its obligations/responsibilities regarding the tour including (a) war, hostilities invasion, act of foreign enemies; (b) rebellion, revolution, insurrection or military or usurped power or civil war or political turmoil (c) epidemic, pandemic, explosion, fire, flood, earthquake or other exceptional natural calamity and act of God; (d) ionizing radiation or contamination by radioactivity from any nuclear fuel, or from any nuclear waste from the combustion of nuclear fuel, radioactive toxic explosive, or other hazardous properties of any explosive nuclear assembly or nuclear component of such assembly; (e) riot, commotion or disorder; (f) any act or omission of any Government instrumentality; (g) a Change in Legal Requirements; (h) strikes, lock outs or other industrial disturbances; and (i) abnormal weather or sea conditions including tempest, lightning, hurricane, typhoon, rain and temperatures. (j) unforeseen cancellation by contractors like hotel, transport, suspension of airlines, railways, Euro star, bus services etc.
  4. Customized Tours mean such tours which are customized to suit specific needs of the customer(s)
  5. ‘Guest/s’ means the person in whose Name or on whose behalf booking and/or registration is made for customized vacations organized by Vacays Leisure Travel.
  6. ‘Independent Contractor’ means a person and/or organization selected by Vacays Leisure Travel to render services including transport, hotel, air, insurance, restaurant, sightseeing to the guest/s. Independent Contractor is not an employee, partner or joint venture of Vacays Leisure Travel.
  7. ‘Tour/s’ means any ‘International Tours’ carried out in any foreign – Country organized by Vacays Leisure Travel.
2. General Explanations:
  1. Each provision/term of these Terms and Conditions shall be severable and if any provision thereof is declared invalid, illegal or unenforceable, then remaining provisions nevertheless shall have full force and effect.
  2. The masculine gender, shall also include feminine gender and vice versa, the singular shall include plural and vice versa and shall include grammatical variations thereof.

2) Scope of Activity:

Vacays Leisure Travel Private Limited is an organization that coordinates all the services of the customized tour to help visit a set of destinations chosen by the customer. Vacays Leisure Travel takes utmost care in selecting all the services and/or Independent Contractors who provide their services, to make our guest/s comfortable on tour. Vacays Leisure Travel select various aspects of the tour such as hotel, restaurant, airline, coach, shipping company etc. and does not have any control over operating of the same. Though Vacays Leisure Travel takes utmost care of our guest/s; Vacays Leisure Travel shall not be held responsible for any loss, harm, injury, death, damage caused by default, omission or act of employees or management of any such agencies or Independent Contractors. All the guest/s booking and / or registering for tour organized / proposed to be organized by Vacays Leisure Travel shall read, understand, abide by, strictly comply and observe all the terms and conditions laid down herein.

We endeavour to update our guest/s from time to time by sending the guest/s various tour related instructions through sms / emails / telephone/ or by any other mode of communication, solely for convenience of the guest/s. Guest/s are advised to visit website www.vacays.co.in to keep yourself updated with the Terms and Conditions, as Vacays Leisure Travel reserves right to change the Terms and Conditions at any time without prior intimation.

3) Proposal Quote:

Vacays leisure travel may provide (on request) facilitation to customers for processing VISA through external consultants. These consultant are 3-rd party contractors and are not employees of Vacays Leisure Travel . Customers are requested to pay the service fee directly to the 3-rd party consultants in case they request facilitation. Customers are also free to engage their own VISA consultants and are under no obligation to choose the ones referred to by Vacays Leisure Travel

Vacays Leisure Travel bears no responsibility for gaps/errors in assistance regarding documentation or lack of appropriate document/VISA, approval/ denial/ grant, date , duration or any VISA related issue as facilitated by the 3rd party VISA consultants. VISA and all travel related documentation at all times shall continue to be the sole responsibility of the customer.

It is responsibility of guest/s to check filled VISA form for correctness before submitting to VISA Consulate. Vacays Leisure Travel shall not be responsible for any errors in the date of Visa granted or delay in granting visa or scanned photographs by the concerned authority. Guest shall be responsible for the photographs specifications provided by different Consulate. All costs and charges in respect of the said application for the visa shall be borne by the guest/s only. Guests must inform Vacays Leisure Travel within a day of receipt of VISA.

Despite submitting all relevant documents and/or attending personal interview, granting of Visa is at the sole discretion of the Embassy or Consulate over which Vacays Leisure Travel has no control. Generally consulate do not give any reason for not granting visa and/or with refusal stamp on passport and Vacays Leisure Travel cannot interfere in VISA process

4) Booking of Tour:

Guest/s Acceptance of the proposed itinerary:
Guest’s Acceptance of the proposed itinerary and/or part/full payment, as the case may be, whichever earlier shall mean acceptance by the guest/s in totality of the Terms and Conditions contained herein.Identity and address Proof of customers is must for Booking of Tour and is also required to be carried on tour/ sight-seeings. You will need to furnish PAN card (among other documents), identity & address proof for us to enable booking you vacation so as to ensure compliance with the ever changing regulatory requirements.
Guest/s’ intention to participate in the tour:
The payment of partial amount of the accepted quote just indicates guest/s’ intention of participation in the tour but does not entitle him to any of the services including travel tickets, visas, hotel accommodations etc. until the full tour payment has been received by Vacays Leisure Travel.
Travelers in need of special assistance:
Vacays Leisure travel, without being held responsible in any way whatsoever, shall make reasonable attempt to accommodate the special needs of customers during the planning of the itinerary and generating quotes
Health:
Guest/s hereby acknowledges that all the guest/s who have booked the tour is well aware about the itinerary and are Medically fit to undertake the said tour.The persons who are and/or who have suffered from any ailments for which they have taken medical treatment and/or have gone into check up and/or hospitalization shall join the tour at their own risk. It is the responsibility of Guest to provide medical certificate on tour or before joining the tour if required by governing authority of the visiting place at your own cost.In case of any health emergency or health related issues while touring, the guest/s shall solely be responsible for it and to make their own arrangements on the tour for medical assistance & other expenses.

5) Insurance:

Guest/s are advised and recommended to acquire adequate Insurance Policy and Overseas Travel Insurance cover to meet expense of hospitalization, accident etc. during the tour. Vacays Leisure Travel facilitates the travel insurance for guest/s upto the age of 70 years wherever it is mandatory and guest needs to pay differential insurance charges for age exceeding 70 years over and above the tour tariff. It is obligatory for the guest/s to make full disclosure of medical condition to Insurance Company that may affect his ability to take up and complete the full tour. Insurance Company and /or service provider reserves the right to call for any written certification of guest/s’ medical fitness before departure. Vacays Leisure Travel is insurance facilitator and is not liable/responsible for any reason whatsoever, for settlement of insurance claims and it is a matter solely between the concerned insurance company and the guest/s.

In case of any unfortunate event while on tour like hospitalization and/or unfortunate demise, it shall be the sole responsibility of the guest/s and/or relative of the hospitalized person/deceased to contact and submit the necessary claim to insurance authorities for further processing of the claim.

6) Payments by Guest:

1. Payment:
  On acceptance of the customised vacation quote/proposal by the customer, Vacays Leisure Travel would provide you a payment schedule for the total cost of the itinerary, which needs to be strictly complied with . In case of any delay in receipt of the payment, Vacays may not be in a position to guarantee the availability of tour components as per the accepted tour itinerary. In such cases alternative components (tours, transfer, flight, ferry) may be provided at the discretion of Vacays. Vacays reserves the right to levy additional charges if the price of components of itinerary escalate , especially if the payment schedule has not been adhered to, by the customer.
2. Flight/transport Booking:
  Some component of vacation itinerary such as flights (and others) have volatile pricing. While we endeavour to block the seats on flights and advice the customers of deadline for ticketing, the block may be lifted by airline without any notice and the prices of the flight may escalate. In such cases Vacays reserves the right to levy additional charges on customer to cover to differential on the same or alternative flight.When the flight is blocked, the customer would be required to provide a written confirm of the booking details including the date of departure/arrival, flight details, airline operator, customer details (including demographic details including name, age, etc and passport details). Vacays Leisure Travel would shall always take a customer confirmation over verbal/email/whatsapp channels to make the above mentioned bookings .
  Tickets shall be blocked and booked by Vacays only on such conformation by the customer. In case there are omissions/oversight by the customer on accuracy of the booking details, the customer shall bear the sole responsibility for the same and also the cost of making any amendments. Vacays Leisure Travel shall in no way be responsible for gaps and oversight by the customer on the confirmed Booking details (including name, spelling, date of birth and other passport details required for making a booking)
  In case of billing errors, Company reserves the right to re-invoice.
3. Tour Tariff:
  The tour cost is calculated for every itinerary quote provided to the customer . Total tour tariff should be paid per the payment schedule intimated by Vacays leisure Travel on acceptance of the itinerary. Interest @ the rate of 18% p.a. will be charge on any delayed payment.All tour tariffs are exclusive of all taxes applicable from time to time. Guest hereby unconditionally accept that the prices, set of services and inclusions may vary as per product, season etc and the same shall not be considered for any kind of comparison universally. Tour tariff mentioned in our website/quotes are at the time of sharing & subject to change.
4. Airlines:
  Airlines are solely responsible for overbooking of seats by the Airline, loss of baggage by the Airline, failure on the part of Airline to accommodate guest/s despite having confirmed tickets, flight delay, change in date or time, no permission to board on flight by Airlines, suspension of operation of Airline etc and no claim of whatsoever nature shall be made by the guest/s against Vacays Leisure Travel. Allotment of seats are in the hands of the airline in group booking. Guest is required to bare additional cost due to delay in flight or cancellation of flight or missed the flight as the case may be. Guests are free to book their own tickets & refund will be as per contract between Vacays Leisure Travel to Airline. Once Air tickets are released as per request of guest, Vacays Leisure Travel will not be responsible for new booking. Policies and terms and conditions of airlines towards booking, cancellation, luggage, change of the airline ticket, meals etc will be applicable. High season surcharge as per the rules of the Airline concerned has to be paid by the guest/s. Any increase in airfare, airport taxes, visa charges, fuel surcharges after the registration shall have to be paid by the guest/s.
5. Accommodation:
  Vacays Leisure arranges hotel bookings as part of our customized vacation packages based on your preferences and requirements. While we strive to select reputable hotels and ensure that your accommodations meet your expectations, please be aware that we do not own or operate these hotels. The services and amenities provided by these establishments are beyond our control, and their availability and quality may vary. We rely on the information provided by the hotels at the time of booking and cannot be held responsible for any discrepancies or issues that may arise during your stay. Any complaints or disputes regarding hotel services must be addressed directly with the hotel management.
  - Check in and check out time:Every guest has to abide by the check-in and check-out time of the respective hotels. For International destinations, generally the check-in time is 3 p.m. and check-out time is at 12 noon. However, check-in and check-out may differ depending upon destination, hotel policy . If guest wants any change therein, guest should manage the same at his own cost with hotel authorities on payment of additional charges, if any.
  - City Taxes: Some international destinations are required by law to collect tourism or city taxes for any overnight stays. Such taxes/charges are NOT included in the itinerary quote and must be paid directly to the Hotel in the destination
  - Additional facilities:Additional facilities including laundry, telephone, mini bar, alcohol, beverages, food, optional excursions, excess baggage fees, shopping, paid toilet etc if availed by the guest/s, have to be paid by the guest/s only before leaving the hotel, ship / cruise or restaurant etc. as the case may be.
  - Direct payment to bank account:

Any payment made directly to Vacays Leisure Travel’s bank account through any electronic mode such as net banking, payment gateway, payment wallet, cheque deposit etc., should be informed within 24 hours with valid documentary proof of payment through physical Copy/email/whatsapp messages.

7) Document:

Passport & VISA processing
1. Passport is a must document required whenever guest/s intend to travel abroad. Passport must be valid at least 180 to 365 days subsequent to the scheduled arrival date of the tour – subject to rules of the specific visa embassy or consulate.
2. Vacays Leisure Travel is not responsible for any damage to the documents including passports mis-handled by Visa agents, VFS Centre, Ambassy, Consulates, Courier Agencies etc.
3. Non Resident Indian (NRI) are responsible for rules of visiting country such as compulsorily holding Person of Indian origin (POI) or Overseas citizen of India (OCI) card while traveling, gap of minimum 2 months between two visits to avoid deportation entry problem through immigration authorities etc.
Loss of Passport:
Before Departure: Vacays Leisure Travel is not liable to compensate cost of new passport or loss of valid / expired visa or any other losses of an applicant in case of loss of passport from consulate, VFS, embassy or courier agency/service company
Visa:
Vacays leisure travel may provide (on request) assistance to customers for processing VISA through external consultants. These consultant are 3-rd party contractors and are not employees of Vacays Leisure Travel . Vacays Leisure Travel does not bear any responsibility for gaps/errors in assistance provided by the 3^rd party VISA consultants . It is responsibility of guest/s to check filled VISA form for correctness before submitting to VISA Consulate.

Guest/s Responsibility:
It shall be sole responsibility of the guest/s to hold required valid travel documents and statutory clearances including court permissions, including passports, visas, confirmed travel tickets, travel insurance including medical treatment, Medical fitness certificate on tour or before departure as per the rules of visiting country any other document used to confirm the services of tour including an arrangement with independent contractor and other statutory certificates, to enable him/her to undertake tour. All travel documents are non-transferable and must be issued in the name of the passport/photo identity holder, otherwise the booking may be cancelled. The guest/s shall ensure timely collection of all such documents enabling them to undertake tour and be present in time for departure. Guest/s should keep certified true copies and photocopies of all travel documents, statutory clearances including court permissions, passports, visas, confirmed travel tickets, Travel insurance. Guest’s are requested to arrive at the airport 3 to 4 hours prior to departure as per Airline guidelines.
Photo identification:
It is mandatory for all guest/s including child travelling are required to carry the Original photo identification in the form of driving license, election ID card, Aadhar Card, Passport, OCI card etc. All guests are required to carry photo identification as required by the rules & regulations of the visiting country. Such rules varies from time to time and country to country and available on official website of the consulate of respective countries and guest/s needs to read it for hassle-free travel.

8) Itinerary Changes:

Force Majeure Situations: In case of force majeure conditions, Vacays Leisure Travel reserves the right to change / modify / vary / alter the tour itinerary / change of date of the tour and/ or tour tariff accordingly. Such changes etc. shall be intimated to guest/s, prior to the departure of the tour or on tour as the case may be. Additional charges, if any, due to such changes etc. over and above the tour tariff have to be paid by the guest/s before or on tour itself as the case may be. No complaints /compensations and/or claiming of refunds beyond the provided refund by Vacays Leisure Travel shall be entertained for limitation and/or non- availability of services beyond the control of Vacays Leisure Travel including museums, restaurants, sightseeing, shopping etc. though included in tour itinerary. Due to certain unavoidable circumstances, other than force majeure conditions, if any day of tour is curtailed/any sight seeing missed/any other services not being provided due to some reason from Company’s side, then Vacays Leisure Travel shall be liable to refund the guest/s, only that portion of the tour amount arrived at for that missed day/missed sight seeing/missed services.
Missed tours/services: For each booking , the date/time, vendor/operator’s contact details are mentioned in the booking vouchers. Guests are responsible for arriving at the common starting/pick-up point of the tour/activities in the destination before the designated hour. Guest would need to make their own arrangements for local transport in case , tours /activities for the day do not include Hotel pickup. If Guests do not arrive on time at the common starting/pick-up point at the scheduled hour , they may miss the activity/tour and will be marked as No-Show. In cases of No-Show , no refunds requests would be entertained in any condition. In exceptional circumstances Vacays may request the operator/vendor to make a partial/full refund for the activity. However Vacays decision of the same request shall remain final and binding
Deviations post booking: If any guest/s wishes to deviate from the accepted itinerary which is already booked, Vacays Leisure Travel shall permit such deviations, but additional charges may apply. For such deviation, the guest/s has to pay full cost differential (new Vs confirmed/booked itinerary), cancellation charges for any component, and a service fee – minimum change fee of INR 10,000 plus applicable taxes. In case the changes are significant, Vacays reserves the right to increase the service fee to make the changes to tour itinerary. Customers may also be required to make the additional payment to Vacays for any additional bookings made, to cover the differential or the full amount of the new bookings. Refunds received for cancelled services (which are part of the accepted and booked itinerary) will be refunded to the customer within 7 days of the receipt of the refund by Vacays Leisure Travel from the vendor

9) Baggage:

Guest/s are responsible for personal belongings and to carry their own baggage. Guest/s have to check the baggage rules at the airport, during any air travel, in coaches, in any train journey, at immigration points, at sightseeing etc and be responsible for the same. The porter-age or the tips for services rendered to carry guest/s baggage to the rooms is guest/s responsibility and have to be paid directly to the service provider. The “porter” or any helper arranged by the guest/s at any train stations, airports, at immigration points or any other place, is the sole responsibility of the guest/s and guest/s shall have to pay tips directly to them.

10) Cancellation Charges:

Vacays prides itself on providing customers with the most flexible customised vacations including maximized refunds in case of cancellations due to unforeseen circumstances.

A standard cancellation fee of 15% of the Vacation is applied to cancel any-time prior to 5 days from the departure, in case customer has opted for fully refundable tour option. The cost base for calculating the refund shall be the cost of tour inclusive of GST but excluding TCS collected. Kindly note that the Cancellation fee shall be applied to the refunds received (which may be lesser than the total tour cost due to mandatory deductions by operators) by Vacays on cancellation of the tour .

In case customers wish to cancel the tour with less than 5 days from the date of departure, Vacays would charge 25% of the total tour cost as Cancellation fee from the refund amount received by Vacays.

General Terms applicable for all type of cancellations:
1. Applicable Refund as per cancellation policy will be paid within 30 working days from the date of cancellation in INR only.
2. No interest will be payable on refund of any cancelled tour
3. Cancellation shall attract the cancellation charges as per the policy
4. Air Ticket Cancellation and deposit forfeit charges are applicable as and when occur under the rules of the concerned Airline are additional cancellation charges to be paid by guest/s immediately.
Cancellation due to VISA rejection
1. The cancellation charges shall be Applicable from the date of intimation of cancelled VISA by guest to Vacays Leisure Travel.
2. Sometimes the VISA processing takes longer time and in few cases VISA is not granted before tour departure or it is delayed. In such cases, Vacays Leisure Travel as a facilitator shall neither be responsible for any consequences nor liable for any refund. The guest shall have to bear all the cancellation and re-booking charges
3. Guest should check all contents in VISA, sticker VISA, E-VISA etc. especially Name as per Passport, Passport No, validity, photographs, signature of the authorized person etc.
  1. Vacays Leisure Travel will not be responsible if immigration office do not allow the guest to leave or enter the country
Cancellation due to force Majeure Situations
1. Under force Majuere Situation, Vacays Leisure Travel reserves the right to Cancel, partly cancel and/or reschedule the tour
2. In case of force majuere event, Vacays Leisure Travel cancel the tour and if payments already been made to their respective suppliers then Vacays Leisure Travel reserves right to refund as & when they receives the same from the respective airlines/land suppliers in their bank account subject to actual cancellation.
3. Fine, penalties or any such payments arising due to not meeting with the requirements of any airport or government authorities including Passport or Visa documents, court orders are responsibilities of guests and to be paid by the guest.
Cancellation due to non payment of Tour Price-Deemed cancellation
1. If full tour tariff is not paid as per terms & conditions and payment schedule, Vacays Leisure Travel reserves the right to cancel the booking with consequent forfeiture of deposit/advance amount/entire part payment made to Vacays Leisure Travel.
2. The bookings shall be processed by Vacays Leisure Travel only after full payment has been received

11) Miscellaneous:

Complaints or Grievances: If the guest has any claim, grievance and / or complaint in respect of services provided by any of the independent contractors, the guest shall immediately notify the same to the independent contractor in writing/email/whatsapp, and a copy shared with Vacays Leisure Travel not later than 7 days thereof to enable Vacays Leisure Travel to take up the matter with the concerned independent contractor.
Privacy of Information: Any Information furnished by the guest/s to the tour leader/ Assistant and/or Vacays Leisure Travel, is subject to disclosure thereof if required by law or by an order of court or the rules, regulations and inquiry by any government / statutory authority.
Government rules for NRI – Non Resident Indian Guest:
All guest/s staying abroad including NRIs or foreigners should abide by all the laws, rules, regulations of Government of India and / or the country concerned while undertaking the tour.
Reference Call: Company reserves the right to refer the guest, on request, to prospective guest for promotion of Vacays Leisure Travel business. Further Company is authorized to send transaction as well as promotional sms/e-mail/phone calls.
Jurisdiction: All disputes pertaining to the tour and any claim arising there under shall be subject to the Court of competent jurisdiction at Bangalore only.

12) Refund conditions:

Refunds if any, for variation/modification/amendments/ alteration and/or cancellations etc. of any tour shall be paid directly to the guest by ‘A/C payee’ cheque or Bank Transfer, in Indian Rupees
No refund shall be payable:
1. for any missed / unused services of the tour including the meals due to whatsoever reason.
2. where part/full deposit is required to be paid in advance to the concerned authorities to enable Company to confirm the reservation and/or VISA
3. if services of the tour are modified, varied, amended, curtail or not utilized due to force majeure.
4. if any guest decides and/or is required to cancel the tour due to any changes made in the rules and regulations by the Government of visiting state/country.
5. if the tour is indefinitely postponed / cancelled due to force majeure and or any other unforeseen calamities.
6. refund is not applicable for International and on certain conditions which
  1. include that such air tickets are non refundable and date change is not allowed.
7. Vacays Leisure Travel is not liable to pay any amount in case the VISA is not received by the guest and / or Company within time. Since, grant / non-grant of VISA and also communication of information in respect of grant / non-grant of VISA is beyond the control of Vacays Leisure Travel, the guest should be mentally prepared for any mental / physical dismay as a result of non-grant of VISA and / or delayed communication which may be just before your date of departure.

13) Liability and Responsibility of Vacays Leisure travel:

The liability of Vacays Leisure Travel is restricted only to the making reservation in accordance with the guest/s requirements and no further.
Company is not liable for
1. Vacays Leisure Travel is mere a travel agent who books services on behalf of their travelers. Vacays Leisure Travel is not responsible for the delayed / canceled service by the independent contractor. However Vacays Leisure Travel would make a sincere effort to get a full/partial refund from the vendor in case the services have not been rendered, however the decision of Vacays will be binding on the customers
2. any loss of person or property caused or damaged or suffered by the guest/s on account of deficiency in services by any independent contractor. Any gesture of courtesy extended by Vacays Leisure Travel to the guest/s to minimize such loss or damage shall not constitute an admission of such liability or a waiver. Vacays Leisure Travel shall in no circumstances whatsoever be liable to the guest/s or any other person for any loss or expenses incurred due to theft or any other reason whatsoever during the tour and the entire responsibility of taking care of their valuables shall be that of the guest/s.
3. train/flight delays, on account of any reason whatsoever rescheduling/cancellation of train / flights inter-connection meals not being served etc.
4. any overstay expenses on account of any delay or changes in air, bus, ship, train or cancellation of special bogie on account of Force Majeure including weather conditions, strike, war, quarantine, or any other reason whatsoever
5. any Sightseeing missed and/or the program being curtailed after commencement of the tour and/or before the due period on account of Force Majeure including any unavoidable circumstances and any reason beyond company control including political, natural calamity, monument under renovation, VIP movement and security, heavy rush at sightseeing places, road traffic congestion, pandemic etc.,
6. any tour, holiday, excursion facility exceeding the total amount paid or agreed to be paid by the guest/s for the tour, including any consequential loss or additional expense whatsoever if the guest/s is not allowed to board the train/flight on account certain reasons beyond the control of Vacays Leisure Travel .
7. any loss of baggage by independent contractor or their agents, hotel staff, bus/coach or during tour including damage or loss caused to the guest due to Force Majeure, negligence or technical fault or any other reason whatsoever on account of any change, amendment or cancellation in their schedule by Airline/Railway Authority/cruises / Euro rail etc.
8. allocation of seats, and food service in the aircraft.
9. any personal injury, sickness, accident, loss, delay, discomfort, consequential loss and/or damage or any damage to baggage or personal effects howsoever caused.
10. death of the guest while on tour and all applicable rules and procedures of law are to be followed strictly and all the procedures pertaining to the death shall have to be tackled and handled by the guest or their relatives themselves at their own cost and consequences.
11. any injury, loss, personal harm, death or damage caused to any person or property by the act or default of the management / employees / agents of any independent contractor.
12. any damages, additional expenses or any consequential losses suffered by the guest/s due to Cancellation, Amendment and / or alteration of any of the services of the tour mentioned in the itinerary / Brochure by Vacays Leisure Travel after the registration by the guest/s.

Vacays Leisure Travel reserves the right to change any information before or after booking the tour due to circumstances/events beyond our control. In case of knowledge of any change, in advance, we or any of our representative shall accordingly notify the guest/s of any such changes by sms and/or email.
